'Might Happen In UP, Not Here' High Court Slams UP Police Over Illegal Arrests Made In Delhi
The Delhi High Court slammed the Uttar Pradesh Police for the illegal arrest of the father and brother of a man. The arrests were made in a complaint by the mother of a 21-year-old woman from Shamli in Uttar Pradesh alleging that her daughter was kidnapped. The HC also noted that the woman was a major and that the UP Police had not recorded her statement before making the arrests.
In a major embarrassment to the Uttar Pradesh Police, the Delhi High Court on Thursday slammed the cops for the illegal arrest of the father and brother of a man who was accused of eloping with a woman from Shamli.
The arrests were made in a complaint by the mother of a 21-year-old woman from Shamli in Uttar Pradesh alleging that her daughter was kidnapped.

Despite the couple stating that they both were adults and got married in July 2021, out of free will, the UP Police allegedly took away the father and brother of the man from their residence in Delhi on the intervening night of August 6 and 7 for 'interrogation'.
The couple had moved to the Delhi High Court stating that the whereabouts of the two arrested men are not known since and that the UP Police had taken them away without informing the Delhi Police.
Noting that the UP Police's actions were illegal, Justice Mukta Gupta said: "This will not be permitted here in Delhi. You cannot do illegal acts over here".

"I want the CCTV footage of the incident. If I find that UP Police had entered Delhi for making these arrests, I will take action," the judge said further.
The HC also noted that the woman was a major and that the UP Police had not recorded her statement before making the arrests.
"Somebody comes to you and you go to arrest people without confirming her age? Whether she is minor or a major?"
"When you investigate, won't you ask the complainant? I will get all the CCTV footage and if I find that if Shamli (UP) police came here in Delhi to arrest them, I'll make sure a departmental enquiry is done against you."

"If you (SHO) and your IO don't know how to read a case file then I don't have any solution to it. You get information to arrest the family members of the man but don't get information to investigate the matter!," the judge said further.
The Court directed the police to record the statement of the woman and stated that it will now allow the couple to be taken out of the jurisdiction.
